Looks like a cypress tree of some sort but not sure. Lower branches have dying off , not sure if they were planted Properly?

Mar 30 2015. I searched some guesses, but I’m giving up. It looks unhappy. Lower leaves of branches are dried, yet most vigorous sprouts are from low on ‘trunk’. Maybe someone is tying to prematurely force shrub-form plant into tree form? Or plant doesn’t like combination of summer heat and soil conditions… maybe. Leaves have yellow or ‘gold’ color. Color looks evenly colored , so i think plant may be a selection/cultivar. The fissured bark (photo appearance) is I think uncommon for apparently young plant. Try genus in Acupressure. https://en.wikipedia.org/wiki/Cupressaceae I don’t think it’s Thuja.
